1. Acceptance of Terms

By downloading, installing, or using Michi Menu Helper ("Michi," "the App"), you agree to these Terms of Service. Michi is developed and operated by Soft Focus Apps ("we," "us," "our"). If you do not agree, please do not use the App.

2. Description of Service

Michi is an AI-powered mobile application that scans restaurant menus to provide estimated nutritional information, dietary guidance, and budget tracking. The App uses artificial intelligence and image recognition to analyze menu items and provide recommendations based on your personal profile and goals.

3. Eligibility

You must be at least 13 years old to use Michi. If you are under 18, you should have permission from a parent or guardian. By using the App, you represent that you meet these requirements.

4. Account Registration

• You may need to create an account to access certain features
• You are responsible for maintaining the security of your account credentials
• You agree to provide accurate information when creating your account
• You must notify us promptly if you suspect unauthorized access to your account
• We reserve the right to suspend or terminate accounts that violate these Terms

5. Important Health Disclaimer

Michi is not a medical device, and its outputs do not constitute medical, nutritional, or dietary advice.

• Nutritional estimates are AI-generated approximations and may not be perfectly accurate
• Actual nutritional content varies based on preparation methods, portion sizes, and ingredients
• Allergen information is provided as a helpful guide but should not be relied upon as the sole source for allergy safety — always confirm with restaurant staff
• Calorie targets and dietary recommendations are general estimates and do not replace professional medical or nutritional advice
• If you have a medical condition, eating disorder, or specific dietary needs, consult a qualified healthcare professional before making changes based on the App's suggestions

You use Michi's recommendations at your own risk. We are not liable for any health outcomes resulting from decisions made based on the App's estimates or suggestions.

6. Subscription & Payments

Free Tier

Michi offers a free tier with limited features, including a limited number of menu scans per week.

Pro Subscription

• Pro features are available via monthly, annual, or lifetime subscription plans
• Payments are processed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device's app store settings

Refunds

Refund requests are handled by the respective app store (Apple or Google) according to their refund policies. We do not process refunds directly. If you experience issues, contact us and we'll do our best to help.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Interfere with or disrupt the App's functionality or servers
• Create automated scripts or bots to interact with the App
• Share your account credentials with others
• Upload harmful, offensive, or misleading content
• Use the App to collect data about other users

8. Intellectual Property

All content, design, graphics, the Michi character, and software within the App are owned by Soft Focus Apps and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without written permission.

You retain ownership of any content you provide (such as photos of menus). By using the App, you grant us a limited license to process this content solely to provide the service.

9. Privacy

Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Michi, you agree to the practices described in our Privacy Policy.

10. Third-Party Services

Michi integrates with third-party services to provide functionality:

• Supabase — Authentication and data storage
• OpenAI — AI-powered nutritional analysis
• RevenueCat — Subscription management

These services have their own terms and privacy policies. We are not responsible for the practices of third-party service providers.

11. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind
• We do not guarantee the accuracy, completeness, or reliability of any nutritional estimates, allergen information, or dietary suggestions
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

12. Indemnification

You agree to indemnify and hold harmless Soft Focus Apps, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of Michi after changes are posted constitutes acceptance of the updated Terms.

14. Termination

You may stop using Michi at any time by deleting the App and, if applicable, canceling your subscription. We may suspend or terminate your access if you violate these Terms. Upon termination, you may request deletion of your data by contacting us.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes will be settled through binding arbitration or in the courts of competent jurisdiction.
